We're going to Disney World today with the grandkids and I'm like, what is going 1:02:24 Speaker 1 on? I mean, she's just, I don't know, dude. I mean, she's been on hospice. All right 1:06:45 Speaker 1 We'll see you tomorrow. 1:06:46 Speaker 1 But this is attorney Kathy Nestor 1:06:48 Speaker 1 that I've had the pleasure to talk to. 1:06:49 Speaker 1 She's a very famous lawyer out of Utah 1:06:52 Speaker 1 and has handled a couple of the biggest cases 1:06:54 Speaker 1 that are currently in the news. 1:06:56 Speaker 1 She can't talk about her most famous case, 1:06:59 Speaker 1 which is going on right now, 1:07:00 Speaker 1 which involves the shooting of a certain individual 1:07:02 Speaker 1 in Utah, a few months back 1:07:05 Speaker 1 that the nation has been mesmerized about. 1:07:07 Speaker 1 But we are gonna talk about the case 1:07:09 Speaker 1 she just finished where there was a verdict 1:07:11 Speaker 1 back in May of this year. 1:07:12 Speaker 1 And Kathy, will you tell us a little bit about that defendant? 1:07:17 Speaker 1 How you got in homes and sort of like, 1:07:20 Speaker 1 so update everybody and what's going on? 1:07:24 Speaker 1 Sure. So hi, Manny. It's nice to see you. 1:07:27 Speaker 1 Thanks for asking me to chat with you today. 1:07:31 Speaker 1 I was asked by my law partner who Wendy Lewis, 1:07:36 Speaker 1 Wendy Lewis. If I would be willing to get into Ms. Richon's case, she is a woman from just outside 1:07:48 Speaker 1 the Park City Utah area in a really small town, not far from Park City, and she was charged and 1:07:57 Speaker 1 accused with killing her husband. 1:08:00 Speaker 1 And my law partner got a call asking if our firm would 1:08:06 Speaker 1 take on the representation of Ms. Richards. 1:08:09 Speaker 1 We were appointed by the county and paid by the county. 1:08:14 Speaker 1 And we were a private law firm. 1:08:17 Speaker 1 We have our own law firm. 1:08:18 Speaker 1 But occasionally, we do accept appointments on homicide 1:08:24 Speaker 1 cases. 1:08:25 Speaker 1 And that was how we got involved in the case. 1:08:28 Speaker 1 Well, you're thinking you've been very kind. 1:08:30 Speaker 1 I mean, the judges call you on these high profile, 1:08:33 Speaker 1 high in cases. 1:08:33 Speaker 1 And so the defendant was Corey Richards. 1:08:36 Speaker 1 And I guess anybody can look it up online 1:08:39 Speaker 1 and see a lot of the stories and such. 1:08:41 Speaker 1 And I guess the primary issue was the Fentanyl overdose. 1:08:45 Speaker 1 And it was done for money because she was in debt. 1:08:47 Speaker 1 So it seems like a lot of these people had a ton of money. 1:08:51 Speaker 1 So it kind of sort of walked us through it once you got 1:08:54 Speaker 1 pointed to the case. What exactly happened sort of what was the background of the allegations? 1:09:00 Speaker 1 And then we'll pick it up from there. 1:09:03 Speaker 1 So when we first got on the case, we knew that it had already been going on about a year. 1:09:10 Speaker 1 There was another law firm that had represented Ms. Richards that she had actually retained herself. 1:09:16 Speaker 1 And they moved to withdraw from the case, which is what led to our appointment. She no longer 1:09:23 Speaker 1 had the financial capability to hire her own lawyer at that point. So that's when we were 1:09:27 Speaker 1 brought in. So we were brought in the case had been going for some time. It was, we knew it was 1:09:33 Speaker 1 very high profile. We knew it was being watched by a lot of people that were interested in the case. 1:09:40 Speaker 1 And we agreed to jump in and it was, we were trying to prepare for preliminary hearings. 1:09:47 Speaker 1 That had not happened yet. And the first thing we noticed when we got in the case was, there was 1:09:52 Speaker 1 is I want to say 12 terabytes of discovery, which is just our word for the evidence that 1:10:00 Speaker 1 the state had that they were planning to use some or all of that trial. So we had to be 1:10:06 Speaker 1 familiar with all of that. And that took some time. I mean, it takes, it's hard to describe 1:10:12 Speaker 1 how much materials is contained in 12 terabytes of information. But needless to say, it's 1:10:20 Speaker 1 hundreds and hundreds of thousands and thousands of pages and hours and hours of videos and 1:10:28 Speaker 1 this investigation had been going on for two years at the point that we got in and 1:10:34 Speaker 1 the state had subpoenaed every 1:10:38 Speaker 1 business entity 1:10:40 Speaker 1 company that she had ever had anything to do with and like the last 20 years, I kid you not. 1:10:46 Speaker 1 So we had just mountains of evidence to familiarize ourselves with and to get to know the case. 1:10:56 Speaker 1 We also had hundreds and hundreds of witnesses in the case potential witnesses that we had to interview get to know investigate. 1:11:07 Speaker 1 So it took a good deal of time before the case got teed up and ready to go for trial. 1:11:13 Speaker 1 So it sounds like the typical, I mean, 1:11:15 Speaker 1 me being a defense lawyer as well. 1:11:16 Speaker 1 It sounds like one of those typical, 1:11:18 Speaker 1 they dump everything on you. 1:11:20 Speaker 1 There's some hidden gems in there. 1:11:22 Speaker 1 And then you give a witness list. 1:11:24 Speaker 1 That's like the phone book. 1:11:25 Speaker 1 And figure it out. 1:11:27 Speaker 1 Yes, that's the thing. 1:11:28 Speaker 1 What I've read, 1:11:31 Speaker 1 she was apparently having an affair. 1:11:34 Speaker 1 There were some financial problems 1:11:35 Speaker 1 that her business was having. 1:11:36 Speaker 1 And then she's accused of trying to poison her husband 1:11:39 Speaker 1 on more than one occasion. 1:11:41 Speaker 1 Can you kind of walk us through what the government's theory was? 1:11:44 Speaker 1 Because obviously all that stuff is super-solacious 1:11:46 Speaker 1 and that's why Core TV covered it. 1:11:48 Speaker 1 And it was quite the extravaganza 1:11:50 Speaker 1 for the time to travel in on. 1:11:53 Speaker 1 Well, that's the problem. 1:11:54 Speaker 1 I mean, they focused on the salaciousness of it. 1:11:56 Speaker 1 And there was very little evidence. 1:11:59 Speaker 1 So this is your classic circumstantial evidence case. 1:12:04 Speaker 1 And I know that you're really, 1:12:08 Speaker 1 your this this interview is kind of geared towards people who are in the legal community and understand 1:12:16 Speaker 1 legal terminology. But I mean a circumstantial evidence case means there's no confessions, 1:12:22 Speaker 1 there's no direct evidence linking my client to you know a murder weapon or you know something 1:12:30 Speaker 1 like that. So really what the state had to do was put on a circumstantial evidence case that 1:12:38 Speaker 1 relied really heavily on whether she had motive to kill him because she was the only people 1:12:46 Speaker 1 in the house the night that he passed were her and her three sons and her husband. So they definitely 1:12:54 Speaker 1 tried to argue the case that, well, you know, she had motive and opportunity. 1:13:01 Speaker 1 But there was no direct to evidence of the other murder. So they spent a great deal of time 1:13:09 Speaker 1 developing, you know, why she would want to kill him or reasons she would have to kill him 1:13:15 Speaker 1 since they couldn't really prove she did kill him. 1:13:18 Speaker 1 So circumstantial cases sometimes I would think are even tougher because it's all speculation 1:13:24 Speaker 1 and sort of rumored innuendo. 1:13:26 Speaker 1 So how do you battle what the average person, you know, when they see it, even if they're 1:13:31 Speaker 1 not lawyers and you know, maybe a lot of non-wears will see this, is saying, well, she 1:13:35 Speaker 1 was having an affair. 1:13:37 Speaker 1 Her business was in trouble, which I don't know why the husband would know about that. 1:13:41 Speaker 1 And then there's a big insurance policy. 1:13:43 Speaker 1 It seems like a classic lifetime movie kind of scenario. 1:13:47 Speaker 1 how do you get around that? Because obviously it sounds pretty damning on its face. 1:13:52 Speaker 1 Well, there's, you know, I think that when you have the benefit of hindsight and you look backwards 1:14:02 Speaker 1 and you have a theory of what you think happened, then what the prosecution did is look backwards 1:14:08 Speaker 1 in their marriage and try to bend, you know, this story of a normal human everyday marriage 1:14:16 Speaker 1 into some evil motive, right? 1:14:20 Speaker 1 And we just didn't believe that that was the case. 1:14:24 Speaker 1 You know, no marriage is perfect. 1:14:26 Speaker 1 I think if anybody looks into any marriage long enough, 1:14:29 Speaker 1 they're gonna come up with some kind of motive 1:14:30 Speaker 1 to kill this spouse. 1:14:33 Speaker 1 If they look hard enough and long enough, 1:14:36 Speaker 1 but that doesn't mean she did kill her spouse. 1:14:39 Speaker 1 And so we really tried to focus on the absence 1:14:42 Speaker 1 of hard evidence that established 1:14:45 Speaker 1 that she did this crime. 1:14:48 Speaker 1 The affair was put on at trial. 1:14:54 Speaker 1 What became evident was that the affair, 1:14:57 Speaker 1 I think some of the jurors have given interviews 1:15:00 Speaker 1 since the trial. 1:15:01 Speaker 1 And I don't even think the jurors believed 1:15:03 Speaker 1 that the affair was the motive. 1:15:06 Speaker 1 The affair ended, it was often on, 1:15:09 Speaker 1 and it ended right after he died. 1:15:11 Speaker 1 There was no plan for them to run off 1:15:14 Speaker 1 and get married or anything like that, 1:15:16 Speaker 1 there was no discussion of long term commitment 1:15:22 Speaker 1 between the two of them. 1:15:23 Speaker 1 And I just don't think that the entrial had turned out 1:15:26 Speaker 1 that that wasn't very compelling as a reason for her 1:15:29 Speaker 1 to harm her beloved boys that extremely just 1:15:35 Speaker 1 because she was having a fling with some guy 1:15:38 Speaker 1 that didn't, I mean, didn't even matter enough 1:15:40 Speaker 1 to her to stay with him when he passed away. 1:15:42 Speaker 1 So what her husband passed away. 1:15:44 Speaker 1 So I don't think that really sure. 1:15:46 Speaker 1 I'm sorry. 1:15:48 Speaker 1 So the insurance policy was actually purchased by her husband back in 2017, 1:15:57 Speaker 1 like years and years and years ago. 1:15:59 Speaker 1 So that policy had been present for a really long time. 1:16:04 Speaker 1 Pretty much everyone I know that has any sort of assets or means 1:16:10 Speaker 1 has some kind of life insurance. 1:16:12 Speaker 1 That's not unusual, especially for a family that has a lot of assets. 1:16:17 Speaker 1 And it wasn't like it was a million dollars, which, you know, to me and to everybody, 1:16:23 Speaker 1 a million dollars is a lot of money. 1:16:26 Speaker 1 But when you look at how much he was making per year, that man was making a lot of 1:16:31 Speaker 1 money and he was very successful in his business. 1:16:34 Speaker 1 And, you know, he was in his, you know, he was very young when he passed away. 1:16:40 Speaker 1 And so it would be like saying for a million dollars, 1:16:44 Speaker 1 I'm gonna cut off an income stream of, 1:16:47 Speaker 1 you know, tens of millions of dollars over our lifetime. 1:16:49 Speaker 1 So it doesn't really make a lot of sense 1:16:51 Speaker 1 when you put it in context like that. 1:16:54 Speaker 1 And I mean, I guess if she needed the money, 1:16:56 Speaker 1 if getting a divorce, 1:16:57 Speaker 1 she would have probably gotten more money 1:16:58 Speaker 1 than a million dollars. 1:16:59 Speaker 1 Oh my goodness. 1:17:00 Speaker 1 That's a church. 1:17:01 Speaker 1 His, oh, she would have gotten, 1:17:02 Speaker 1 she would have gotten half of everything 1:17:04 Speaker 1 if she'd gotten a divorce, 1:17:05 Speaker 1 which would have been significantly more than that. 1:17:08 Speaker 1 So what about his family? 1:17:10 Speaker 1 I assume at this point she's the devil 1:17:12 Speaker 1 and they probably came out and testified 1:17:14 Speaker 1 pretty strongly or publicly against her. 1:17:17 Speaker 1 Well, obviously, I mean, they lost someone. 1:17:19 Speaker 1 They loved very much. 1:17:20 Speaker 1 And they were devastated by the loss of their brother 1:17:24 Speaker 1 and their son. 1:17:25 Speaker 1 And as any family of a decedent, 1:17:31 Speaker 1 they wanted justice. 1:17:33 Speaker 1 They believe from the beginning, 1:17:36 Speaker 1 literally the night that the police showed up at the house. 1:17:40 Speaker 1 Family members had made statements that they believed 1:17:42 Speaker 1 Corey was involved before they even knew how he had died. 1:17:46 Speaker 1 So they suspected her from the very beginning. 1:17:49 Speaker 1 They hired a private investigator that they spent over $100,000. 1:17:56 Speaker 1 That all came out at trial. 1:17:59 Speaker 1 Trying to put together the case that the police had not put together. 1:18:03 Speaker 1 And then the private investigator basically testified 1:18:06 Speaker 1 that he turned everything he had over to the police. 1:18:10 Speaker 1 And that resulted in her being charged. 1:18:14 Speaker 1 So the family was extremely involved 1:18:17 Speaker 1 in this prosecution from the very beginning. 1:18:21 Speaker 1 And so it was definitely a mission of the family 1:18:28 Speaker 1 to make sure that she was convicted. 1:18:30 Speaker 1 Did this private investigator get messed up the crime scene or anything like that as far as that goes? 1:18:36 Speaker 1 Oh yeah. 1:18:37 Speaker 1 I see the police were doing whatever and he got in there and how does that work? 1:18:41 Speaker 1 So, he admitted that on the stand that he had been in the home for lengthy periods of time with no one present. 1:18:52 Speaker 1 Going through documents, going through physical evidence. 1:18:56 Speaker 1 actually removed evidence from the home. 1:18:59 Speaker 1 He broke into a safe. 1:19:00 Speaker 1 He took a safe out of the house. 1:19:02 Speaker 1 All this came out of trial and took it 1:19:05 Speaker 1 and had it busted open at a safe store. 1:19:10 Speaker 1 So I mean, it was, I've never really had a homicide case 1:19:13 Speaker 1 before where the year before the person was charged 1:19:17 Speaker 1 because he passed away in March 1:19:20 Speaker 1 and she wasn't arrested until May of the following year. 1:19:25 Speaker 1 So you had all of this time where this investigator was out, 1:19:30 Speaker 1 investigating the case while she was just, 1:19:32 Speaker 1 you know, living her life with her sons 1:19:34 Speaker 1 and trying to deal with the loss of her husband. 1:19:37 Speaker 1 And then the second she was arrested, 1:19:39 Speaker 1 he was in the home for days and days and days 1:19:42 Speaker 1 going through physical evidence, 1:19:44 Speaker 1 not in the presence of police. 1:19:47 Speaker 1 That just sounds bizarre. 1:19:48 Speaker 1 It was. 1:19:51 Speaker 1 I mean, that almost seems like it'd be embarrassing 1:19:53 Speaker 1 the place and taining a lot of stuff. But was that any consequence to the jurors after you guys talk to him? 1:20:01 Speaker 1 The jurors thought he was great. He was a somewhat of a character, this individual, and they found him to be amusing and charming. 1:20:10 Speaker 1 And I just don't think the jury grasped what that interference with the evidence, the significance of that. They were just very 1:20:22 Speaker 1 in tranced with his testimony because he was kind of a character and he was 1:20:32 Speaker 1 entertaining for them to watch. So with regards to the actual murder and the 1:20:38 Speaker 1 fentanyl overdose, I'd read previously that she made a scene which was fentanyl and 1:20:44 Speaker 1 that didn't work. So how exactly does the government say that she overtosed 1:20:50 Speaker 1 to the federal. Well, that's the fascinating part about this case. They don't know. They couldn't say 1:20:58 Speaker 1 there was no evidence whatsoever, no physical evidence whatsoever about fentanyl in a sandwich. 1:21:05 Speaker 1 They had no evidence of that. None. The only thing they had was that she had purchased 1:21:12 Speaker 1 just an egg sandwich for her husband, like at nine in the morning. 1:21:19 Speaker 1 And I mean, we tried to get across to the jury that you would eat an egg sandwich right 1:21:23 Speaker 1 away because I mean, it would be gross if you ate it hours later, right? 1:21:31 Speaker 1 And so the timing didn't match the physical evidence, but at some point around 11 a.m., 1:21:38 Speaker 1 He texted and says he's not feeling well. 1:21:40 Speaker 1 And he's gonna lay down. 1:21:42 Speaker 1 And it looks like he took a nap for about an hour and a half. 1:21:45 Speaker 1 And that's the evidence that she tried to kill him. 1:21:47 Speaker 1 And then he got up and was fine 1:21:48 Speaker 1 and took the kids to play soccer. 1:21:50 Speaker 1 So that's the whole sandwich story. 1:21:53 Speaker 1 As far as the fentanyl that got into a system, 1:21:56 Speaker 1 the state had to admit, 1:21:58 Speaker 1 and trial they have no idea how it got into his system. 1:22:02 Speaker 1 There was speculation that maybe she tried to put it into a drink. 1:22:06 Speaker 1 However, the drink cups were present when the police came to the house sitting out, which obviously, you know, was liquid still in them. 1:22:15 Speaker 1 So if you had tried to murder someone, why in the world would you have the evidence just sitting there? I mean, that doesn't make any common sense. 1:22:23 Speaker 1 So, you know, it was always 1:22:26 Speaker 1 We argued from the beginning that these were pills that were voluntarily taken by this individual who may not have realized that he had, you know, fentanyl in his pills. 1:22:38 Speaker 1 He had an empty expired pill bottle right beside his bed when they found his body, which is a common way that people who are holding on to illicit drugs. 1:22:51 Speaker 1 They put him in expired pill bottles. So it doesn't look suspicious, right? 1:22:55 Speaker 1 And he had just returned from a trip hunting trip to Mexico. And so we tried to 1:23:00 Speaker 1 point out to the jury that, you know, this could be a situation where he went to Mexico. 1:23:04 Speaker 1 God, pills that he didn't realize had fentanyl or maybe he did realize had fentanyl. We don't know. 1:23:10 Speaker 1 But didn't realize the strength of it took a pill and no deed and died. I mean, that's that was what the evidence showed. 1:23:17 Speaker 1 That was what the physical evidence showed. 1:23:19 Speaker 1 So the pill bottle that you guys did having, 1:23:22 Speaker 1 did he have like something for back pain 1:23:24 Speaker 1 that he'd taken in the past or? 1:23:26 Speaker 1 Yes, so that pill bottle play. 1:23:28 Speaker 1 So he struggled a lot with pain. 1:23:31 Speaker 1 And we got that in at trial that he had chronic pain. 1:23:35 Speaker 1 So and he had had, we had a big evidentiary battle 1:23:40 Speaker 1 over trying to get in that he had had a problem 1:23:42 Speaker 1 with pain pills as far back as high school. 1:23:45 Speaker 1 And the judge wouldn't let it come in before the jury. 1:23:49 Speaker 1 We also had a big debate with over evidence. 1:23:55 Speaker 1 We had a witness who was going to testify that the 1:24:01 Speaker 1 decision had asked to buy fentanyl from him about a year and a 1:24:05 Speaker 1 half, two years before. 1:24:07 Speaker 1 And the judge would not allow that in. 1:24:09 Speaker 1 So the jury never heard that he had been seeking fentanyl 1:24:12 Speaker 1 from somebody, which we thought was really devastating. 1:24:15 Speaker 1 We couldn't get that evidence in because we thought that 1:24:17 Speaker 1 was extremely consistent with the theory that we had, that he was, you know, voluntarily 1:24:23 Speaker 1 taking pills and either didn't know he took fentanyl or didn't mean to take as much as he did. 1:24:29 Speaker 1 That seems like a pretty big error for the geology because I mean that would undercut the whole 1:24:34 Speaker 1 motive issue and show another cause of death that's viable. So I'm guessing you guys are still 1:24:41 Speaker 1 on appeal and the only big issue. Oh for sure. And I mean we we argued about it for a really 1:24:47 Speaker 1 long time, you know, it was a public argument and all came out and we just, the judge felt that the 1:24:54 Speaker 1 hearsay was not, we made an argument that it was reliable here saying why and that it should meet 1:25:01 Speaker 1 the catch all reliable hearsay exception. The judge just disagreed with us and he wins, so he kept it out 1:25:10 Speaker 1 and we thought that was really a serious injustice that that evidence didn't get before the jury. 1:25:16 Speaker 1 they should at least know that. 1:25:18 Speaker 1 So for the non-lawyer's here, 1:25:21 Speaker 1 how is it a witness that testifies and says 1:25:24 Speaker 1 the guy that died asked me to sell him fentanyl pills 1:25:28 Speaker 1 and he dies of a fentanyl overdose? 1:25:30 Speaker 1 How does that become hearsay versus just a pure fact 1:25:36 Speaker 1 by a decision that's dead? 1:25:38 Speaker 1 And what is this guy's inkling to say anything like that? 1:25:41 Speaker 1 I mean, what does this guy get out of it? 1:25:43 Speaker 1 So how is it not a trustworthy statement 1:25:45 Speaker 1 come in and admit to their own wrongdoing saying I'm selling this guy drugs? 1:25:50 Speaker 1 Well, he didn't sell him drugs. He didn't have fentanyl. He was shocked that the guy had asked him for it. 1:25:55 Speaker 1 So he's not actually a drug dealer. The testimony that, so that was not an issue. But he, 1:26:04 Speaker 1 you know, the theory of hearsay is that statements that are made outside of court 1:26:09 Speaker 1 from one person to another lose reliability if you can't come in court and say it to the jury directly. 1:26:16 Speaker 1 So it's kind of like the old game of operator where you sit around in a circle and someone whispers in your ear 1:26:23 Speaker 1 and then you tell someone what they told you and you tell someone what they told you and by the time it gets to the end 1:26:28 Speaker 1 it doesn't resemble anything that was actually said. So the law kind of has a similar 1:26:32 Speaker 1 or the importance for evidence that is repeated 1:26:37 Speaker 1 through other people. 1:26:38 Speaker 1 Just because it becomes less and less reliable, 1:26:40 Speaker 1 the farther away it gets from a person who said it, right? 1:26:44 Speaker 1 But there are exceptions. 1:26:45 Speaker 1 And you can put on a case that there's something 1:26:49 Speaker 1 about the statement that makes it particularly reliable 1:26:52 Speaker 1 even though it traveled through someone else. 1:26:54 Speaker 1 And so that's what we tried to do, 1:26:56 Speaker 1 but the judge just wasn't gonna have it. 1:26:59 Speaker 1 I guess it just seemed so coincidental 1:27:00 Speaker 1 he asked this guy, even though he's not a drug, he ought to do it, which would imply that 1:27:04 Speaker 1 he was looking forward, he had pain issues with opiates. 1:27:07 Speaker 1 Yes. It seems like it really guts the case at that point. 1:27:11 Speaker 1 It would have. We were really pretty devastated that didn't come in. 1:27:16 Speaker 1 I read about the maid that they had saying some negative things about your client or 1:27:23 Speaker 1 I guess you testified. Did that have any significant plans setting up this whole 1:27:27 Speaker 1 all poisoning a theory that the government had? 1:27:31 Speaker 1 Well, I mean, once they found her, 1:27:33 Speaker 1 that was what gave them, I guess, enough evidence 1:27:36 Speaker 1 to go ahead and charge my clients. 1:27:39 Speaker 1 That's what precipitated the actual filing of the charges. 1:27:44 Speaker 1 So the testimony came out that our client originally, 1:27:51 Speaker 1 this individual had claimed that our client 1:27:53 Speaker 1 had been asking for pain pills for oxy. 1:27:55 Speaker 1 And that was her original story, and that's what she told the police. 1:28:00 Speaker 1 And that's what the person who sold them the drugs told the police. 1:28:03 Speaker 1 Then the police came back, threatened her, the lady that worked for Ms. 1:28:11 Speaker 1 Richards, threatened her with jail, threatened her with prison and prosecution, 1:28:17 Speaker 1 unless she told them what they wanted to hear. 1:28:21 Speaker 1 And so then she changed her story and said, oh, right. 1:28:24 Speaker 1 She asked me for fentanyl, which there's, 1:28:29 Speaker 1 um, you know, hours and hours and hours of testimony and cross examination that my partner did 1:28:35 Speaker 1 of that individual, where basically she admits, you know, I changed my story. 1:28:39 Speaker 1 You know, they gave me these ultimatums and, you know, she asked them to tell me what you want me 1:28:45 Speaker 1 to say basically. 1:28:46 Speaker 1 I mean, not almost exactly those words. 1:28:48 Speaker 1 and then changed your story and gave them what they needed to charge our client. 1:28:53 Speaker 1 That was the only connection they could make between our client and fentanyl was that testament. 1:28:58 Speaker 1 That was it. 1:28:59 Speaker 1 And then the guy who sold the drugs came out and said they didn't look anything. 1:29:04 Speaker 1 I did not sell fentanyl. 1:29:06 Speaker 1 Fentanyl looked different and had a different. 1:29:08 Speaker 1 I wasn't even selling fentanyl at that time. 1:29:10 Speaker 1 I didn't have a fentanyl source. 1:29:12 Speaker 1 I only sold prescription oxycontin or oxycodone. 1:29:17 Speaker 1 And so, you know, that's, he was getting people's prescriptions 1:29:22 Speaker 1 and then selling them. 1:29:23 Speaker 1 So he wasn't even getting them like off street drugs. 1:29:27 Speaker 1 And he was, I thought he was a very compelling witness. 1:29:29 Speaker 1 I mean, you know, he's a drug dealer. 1:29:30 Speaker 1 So he's got credibility issues. 1:29:32 Speaker 1 But he was very, I mean, he was very straightforward 1:29:35 Speaker 1 on the stand. 1:29:36 Speaker 1 He just said, I sold Oxy. 1:29:38 Speaker 1 So I really believe there was reasonable doubt 1:29:42 Speaker 1 that could connect our client to fentanyl in any way. 1:29:44 Speaker 1 I guess just from a late person's perspective, it seems like I understand it's the defendant's 1:29:52 Speaker 1 statement. 1:29:53 Speaker 1 So the rules are different. 1:29:54 Speaker 1 But the maid can lie about what happened. 1:29:58 Speaker 1 And that's still okay, even though your client never made those statements. 1:30:02 Speaker 1 But some guy that says the dead husband asked me for this. 1:30:06 Speaker 1 That's just not good enough when he had a consistent story versus the other way around. 1:30:11 Speaker 1 Unfortunately, that's one more role of evidence that ways against criminal defense defendants. 1:30:18 Speaker 1 So the defendants statements are not considered here say if it's the prosecution that's 1:30:24 Speaker 1 introducing them. 1:30:25 Speaker 1 So that's a huge disadvantage to people. 1:30:29 Speaker 1 And a big reason why lawyers are always telling their clients, don't make a statement, 1:30:35 Speaker 1 don't talk to the police, don't talk to anybody because anything you say is fair game 1:30:41 Speaker 1 and can come into trial no matter who you say it to. 1:30:44 Speaker 1 Some of these super high profile cases, obviously, 1:30:48 Speaker 1 with all this salacious evidence, which I'm sure 1:30:51 Speaker 1 may well were powered the jury or a charismatic private 1:30:54 Speaker 1 investigator, which seems crazy. 1:30:56 Speaker 1 How do you actually select a jury that's not? 1:31:00 Speaker 1 This might be one of those cases where people 1:31:02 Speaker 1 want to be on the jury, because everybody 1:31:03 Speaker 1 wants a book deal in the back end, or have their five minutes 1:31:06 Speaker 1 and doing interviews and stuff. 1:31:07 Speaker 1 So how do you sort of get to the heart of the matter 1:31:11 Speaker 1 on a case like this where people can say 1:31:13 Speaker 1 they can be fair and impartial 1:31:15 Speaker 1 and everybody knows what's going on? 1:31:17 Speaker 1 You know, obviously it's a challenge. 1:31:20 Speaker 1 We worked really hard to screen the jury panel 1:31:27 Speaker 1 and eliminate anybody who had preexisting knowledge 1:31:32 Speaker 1 of this case who had been following it in social media 1:31:35 Speaker 1 who had been following it on the news. 1:31:38 Speaker 1 And even some of the jurors that got selected 1:31:42 Speaker 1 had a basic knowledge of the case, 1:31:44 Speaker 1 like they vaguely remembered hearing about it 1:31:47 Speaker 1 or had seen like one news story, 1:31:49 Speaker 1 but really didn't, hadn't, according to them, 1:31:53 Speaker 1 had not formed any opinions yet about the case. 1:31:57 Speaker 1 But we really strongly believed 1:32:00 Speaker 1 we could not get a fair trial in that county. 1:32:03 Speaker 1 And we had asked to change the venue to a county that just wasn't so saturated with everyone in the, I mean, you know, Park City, Utah, and it's surrounding areas is not, you know, a large, large community. 1:32:18 Speaker 1 So everybody talked about this case because they most people knew someone who was involved, right. 1:32:23 Speaker 1 So we really wanted to get to a bigger city where people, you know, had lives and we're busy and hadn't been talking about this case. 1:32:30 Speaker 1 We had experts that took the stand and talked about the saturation of media in that area and the community knowledge. 1:32:40 Speaker 1 And we lost. I mean, we just couldn't convince the judge. He was convinced we could find, you know, eight people that, you know, didn't have biases. 1:32:51 Speaker 1 and he would not allow us to change to the larger cities. 1:32:55 Speaker 1 So that we took it up on an interlocatory appeal, 1:32:58 Speaker 1 which means an appeal before the case went to trial, 1:33:01 Speaker 1 and we were not successful. 1:33:04 Speaker 1 Now you said eight people. 1:33:05 Speaker 1 So is you telling of a strange states 1:33:07 Speaker 1 that doesn't require 12 jurors like we hear on TV all the time? 1:33:12 Speaker 1 Yes, it is. 1:33:13 Speaker 1 But you still need to get out of this verdict, right? 1:33:16 Speaker 1 Yes. 1:33:18 Speaker 1 Okay. 1:33:18 Speaker 1 I know I was in the military, 1:33:19 Speaker 1 and it just takes two thirds to connect. 1:33:21 Speaker 1 So that just seems bizarre that you don't need 1:33:24 Speaker 1 fallagers. 1:33:26 Speaker 1 That just, I assume, hopefully that'll change soon for you guys. 1:33:29 Speaker 1 We did, we did file a motion asking for 12 1:33:31 Speaker 1 and we lost that as well. 1:33:33 Speaker 1 The judge said no. 1:33:36 Speaker 1 All right, so without taking up too much of your time. 1:33:39 Speaker 1 So what are next steps now that it really seems like, 1:33:42 Speaker 1 it was kind of one way traffic in this trial based on 1:33:46 Speaker 1 what seems like could be a reasonable explanation 1:33:48 Speaker 1 as to where the fentanyl came from. 1:33:51 Speaker 1 So what can you do to help this woman? 1:33:53 Speaker 1 Because I guess anybody can go by and see 1:33:55 Speaker 1 your life without parole, which obviously, 1:33:58 Speaker 1 as you can get. 1:33:59 Speaker 1 Yeah. 1:34:01 Speaker 1 I mean, it's the most devastating, 1:34:03 Speaker 1 short of the death penalty, 1:34:04 Speaker 1 it's the most devastating verdict sentence you can get. 1:34:09 Speaker 1 So obviously, the fight is now switching 1:34:13 Speaker 1 to a different venue. 1:34:14 Speaker 1 We have a motion for new trial that has been filed. 1:34:18 Speaker 1 The judge has not ruled on that yet. 1:34:20 Speaker 1 We asked the judge to step aside and appoint a different judge 1:34:25 Speaker 1 to decide the motion because in the motion we declare, 1:34:28 Speaker 1 we, one of our grounds for the motion for new trials 1:34:32 Speaker 1 that the judge was, we were denied a fair trial 1:34:37 Speaker 1 due to the fact that the judge was treating the state 1:34:42 Speaker 1 very differently than he was treating the defense 1:34:44 Speaker 1 in front of the jury. 1:34:46 Speaker 1 And we had, you know, clips that we attached. 1:34:49 Speaker 1 and affidavit. So obviously was our position. Look, it's really hard for you to be the one to decide if you were fair, not. 1:34:56 Speaker 1 So we're asking that another judge step in and make that decision. 1:35:01 Speaker 1 And we lost that as well. So the judge is going to be deciding 1:35:06 Speaker 1 himself if he was fair or if he was biased.
